Moore Kingston Smith achieves £2m settlement for Horizon Post Office scandal sub-postmaster
Moore Kingston Smith recently supported a former sub-postmaster, severely affected by the Post Office scandal, in preparing a consequential loss claim under the Group Litigation Order (GLO) scheme, working alongside the client and their solicitors, Taylor Rose.
The claim had been ongoing for several years prior to our involvement, during which limited progress had been made in advancing a fully evidenced position. Following our instruction, work was undertaken to build the claim according to GLO scheme guidelines and the application of business interruption quantification first principles. This involved calculating the past and future financial impact of the scandal, both with regard to the client’s business losses and loss of earnings, clearly evidencing the link between the Horizon-related issues and the losses incurred.
While an initial fixed compensation payment of £75k had previously been offered to the former sub-postmaster and his previous legal advisors, the fully supported submission set out a materially different position. A comprehensive claim was submitted within four months of our appointment, resulting in a fair and just settlement of over £2 million. Our report was not disputed, and compensation was accepted within one year of our appointment.
The outcome demonstrates the importance of a structured and coherent, evidence-led approach in complex business interruption compensation claims, underpinned by a detailed understanding of the claimant’s position and the impact of the interruption.
The former sub-postmaster commented:
“Words cannot fully express my gratitude for your support throughout this process. I truly appreciate the work that went into the forensic report and the strength of the supporting evidence, which played a major role in achieving such a positive outcome.”
Ben Leandro commented:
“Speaking on behalf of the MKS team, we are delighted to have helped secure a fair and just settlement for our client, who had faced significant adversity over a prolonged period. The positive result reflects the importance of working closely with a claimant to fully understand their situation and obtain supportable evidence to form the basis of a robust loss calculation. Few cases have been as rewarding, and we hope this result gives confidence to other sub-postmasters in a similar position as they seek to move forward.”
